NIL Analysis Assignment

Alexis Smith is a women’s softball player at Big Time University and has hired IMG to represent her in her NIL activities. She has disclosed a proposed endorsement contract with Nike in which she will appear in three national television commercials featuring newly signed Nike college athletes. As part of her endorsement with Nike she will post at least 10 promotional videos or messages on social media, either Instagram or TikTok, between March 15, 2023 and April 30, 2023. Big Time University has a global sponsorship apparel agreement with adidas. To announce the new partnership, Alexis and Nike have requested permission to shoot a video on campus and use portions of those videos in their national television campaign. Lastly, she is exploring a partnership to release an “official” named jersey with her name on the back and would like to incorporate University marks/logos on the jersey.

Using the Big Time University NIL policy that is provided, evaluate Alexis’ proposed NIL activities and determine:

(a) whether such activities would be permissible NIL activities under the NIL policy,

(b) what disclosures, if any, are required and when, and whether those disclosures have been satisfied

(c) what permissions or authorizations the athletes would need to engage in the proposed NIL activity;

(d) any additional limitations or issues that the athlete may need to consider to ensure that she is in compliance with university policy.
