Kumar (2022) defines marital rape as the nonconsensual sexual activity or intercourse perpetrated by one spouse against the other. This type of partner abuse occurs within established intimate relationships, including marriages and other legally recognized partnerships. Kumar emphasizes that this form of intimate partner violence may involve “sexual intercourse, oral sex, anal sex, or any other unwanted sexual acts” (p. 120). Historically, marriage was treated as a contract that implied automatic consent to sexual activity, which caused marital rape to be largely overlooked as a legal and social issue. This implicit disregard of autonomy, individual agency, and basic rights reinforced the notion that one partner has the right to control or use the other’s body without consent, perpetuating an unequal power dynamic within the relationship. Although progress has been made in criminalizing marital rape in the United States, this article discusses how this issue is related to partner abuse. With references
